就研究现状来看,习惯法仍是一个不确定的概念,法学界主要有两种观点:一是得到国家认可并由国家强制力保证实施的规范;二是独立于国家制定法之外,具有普遍强制力的社会规范。对这些定义加以分析可以得到:习惯法是存在于特定地域内,由特定组织、群体实施并保障其强制性的行为规范。习惯法与一般习惯相比,具有内容上的权利义务性的特征,与制定法相比又更具社会历史性、地域性以及形式上的多样性。
From the research status quo, customary law is still an indefinable concept. There are mainly two kinds of opinions in the legal profession: one is the standard that is recognized by the state and guaranteed by the national coercive force; the other is that it is independent of the national enactment law, Common coercive social norms. An analysis of these definitions shows that customary law is a code of conduct that exists within a particular area and that is enforced by specific groups and groups and that guarantees its compulsion. Compared with the customary law, customary law has the characteristics of rights and obligations of content and is more social, historical, regional and formal diversity than the statute law.
