为解决目前模拟法庭教学中脱离实践和效果不理想的问题,采用了质的研究和实验验证的方法,提出了模拟法庭教学方案的改进建议。在考察了目前模拟法庭教学当中出现的主要问题,包括教学制度安排、案例选择改变、学生角色定位、庭审设置和评分机制上的问题;并针对问题设计模拟诉讼规则。通过组织比赛的方式,验证模拟法庭教学方案的探索思路,从而提出了五项改进建议:①确立课堂规则,发布指导手册;②建立案例库;③缩减课堂容量,建立竞赛机制;④建立法官主导庭审模式;⑤利用规则微调实现学生不同能力的锻炼。通过实验总结出的结果,改进了模拟诉讼规则,将其应用到教学当中,取得了较为理想的效果。
In order to solve the problem that mimicry court is out of practice and the effect is not satisfactory, this paper adopts the method of qualitative research and experimental verification, and puts forward the suggestion of improving the moot court teaching plan. This paper examines the main problems that appear in the teaching of moot court, including the arrangement of teaching system, the change of case selection, the positioning of student roles, the establishment of courtroom and the scoring mechanism. The rules of simulation litigation are also designed according to the problems. Through the way of organizing competitions, this paper validates the exploration of moot court teaching plan, and puts forward five suggestions for improvement: ① establishing classroom rules and issuing instruction manuals; ② establishing case base; ③ reducing classroom capacity and establishing competition mechanism; ④ establishing judge-led Trial mode; ⑤ fine-tuning rules to achieve different abilities of students exercise. Through the experimental conclusion, the simulation rules are improved and applied to the teaching, and the ideal result has been achieved.
