消费者协会作为社会团体组织,其首要职能是通过自己的活动提高消费者的消费能力,监督经营者的行为,事先预防侵害消费者权益的行为。《消费者权益保护法》虽明确规定消费者协会具有七项职能,但由于配套制度和设施的落后,其防预职能未能充分发挥。针对此种情形,在宣传教育、检查监督、检测机构等方面,有必要探讨其防御职能充分行使的路径。
Consumers associations as social organizations, its primary function is to improve consumer spending power through their own activities, supervision of the behavior of operators, in advance to prevent violations of consumer rights and interests behavior. Although the Consumer Protection Law clearly stipulates that consumer associations have seven functions, due to the backward systems and facilities, the prevention and pre-emptive functions have not been brought into full play. In view of this situation, it is necessary to explore the path of full exercise of their defense functions in the areas of publicity and education, inspection and supervision, and inspection agencies.
