我国现行征收制度存在严重问题,征收权的主体应由国家享有,征收中的公共利益应当作出较为明确的界定,我国相关法规,未能区分私人利益的拆迁和公共利益的拆迁,但是征收和拆迁之间的关系因征收是否涉及公共利益或私人利益的拆迁而各不相同。
