随着数字经济的发展,特别是数据驱动型业务的不断出现,隐私保护与反垄断这两个传统上没有关联的问题日渐联系在一起。一些国家、地区的反垄断执法部门也开始关注数据隐私问题,相关理论探讨日渐活跃。现阶段来看,数据隐私保护是否应纳入反垄断法框架仍面临相关质疑。本文结合现有研究文献以及域外最新执法进展,就反垄断执法中的数据隐私保护问题作一简要梳理,认为反垄断执法应围绕具体行为的反竞争效果展开,但如何构建一套具有可操作性的直接与隐私保护相关的竞争损害理论,仍待学界深入研究。
With the development of the digital economy, especially the continuous emergence of data-driven businesses, the two traditional unconnected issues of privacy protection and antitrust are becoming increasingly linked together. Anti-monopoly law enforcement agencies in some countries and regions have also begun to pay attention to the issue of data privacy, and relevant theoretical discussions have become increasingly active. At this stage, whether data privacy protection should be included in the framework of antitrust law is still facing relevant questions. Combining with the existing research literature and the latest progress of law enforcement in the field, this paper briefly reviews the data privacy protection in antitrust enforcement. It holds that antitrust enforcement should focus on the anticompetitive effect of specific behaviors. However, The theory of competition damage directly related to privacy protection is still subject to further study in academia.
