随着缓刑适用率的逐渐提高,缓刑适用过程中存在的如决策程序透明度不高、考察机制不到位、不规范等问题应予以重视。文章从基层法院适用缓刑的现状及存在的问题入手,探讨检察机关加强对审判环节中法院决定适用缓刑的监督的方法途径。可从事前、事中、事后三个节点即加强法院适用缓刑的监督,事前监督即延伸事前监督,增设有检察机关参与的缓刑听证制度;事中监督即重视事中监督,发挥检察机关缓刑量刑建议的作用;事后监督即强化事后监督,对适用缓刑不当的判决适时进行抗诉,使缓刑制度能在实践中得到更好的发挥。
With the gradual increase of the probationary application rate, problems such as poor transparency of decision-making process, inadequate investigation mechanism, non-standardization, etc. should be paid attention to in the process of applying probation. The article starts from the status quo and the existing problems of probation in grass-roots court and discusses ways and means of procuratorial organs to strengthen the supervision over the court’s decision to apply probation in trial. The three nodes before, during, and afterwards should be strengthened to supervise the application of probation by the court. Prior supervision means extending supervision in advance and setting up a probation hearing system with the participation of the procuratorial organs. In the matter, the supervision attaches great importance to the supervision of the matter and gives full play to the probation punishment of the procuratorial organs The role of post-supervision is to strengthen the supervision afterwards, to protest the application of the probationary sentence in due course, so that the probation system can be better played in practice.
