从工作机制上破解执行难

造成“执行难”的原因是多方面的,法院内部工作体制、机制设计的不科学、不合理,是其中的一个重要因素。正如,最高人民法院副院长沈德咏同志指出的:“当前,执行机构改革是重中之重”。目前,法院在执行工作方面存在的问题主要有四个方面:一是执行权力过于集中,缺乏监督。在律师中流传着一句话:一审、二审审得再好也没用,一个执行法官就可以把你的案子“干掉”(意为不公正的执行)。话虽然偏激,但却反映了一个事实:一般执行案件都是一个执行员从头办到尾,能不能结案就是由一个人掌控。一些执行组的设立大多也仅是具有形式,没起到实质性的监督作 The reasons leading to the “difficult implementation” are many. The reason is that the internal work system and the mechanism design of the court are not scientific and unreasonable. This is an important factor. Just as Comrade Shen Deyong, vice president of the Supreme People’s Court pointed out: “Currently, the reform of the executive body is the most important issue.” At present, there are mainly four aspects to the implementation of the court’s work: First, the executive power is too concentrated and lack of supervision. There is a saying circulated among lawyers that in the first instance, it is useless to judge the second instance, and an enforcement judge can “kill” your case (meaning unjust execution). The words although extreme, but it reflects the fact that the general implementation of the case is an executive from start to finish, whether the case can be closed by one person. The establishment of some of the executive teams is mostly of a mere formality, with no substantive oversight
