浙江省宁波市中级人民法院做出了第一例承认和执行在中国内地做出的外国仲裁裁决的民事裁定,受到了业界的普遍关注。本文集中讨论了国际商会仲裁院能否在中国内地仲裁,国际商会仲裁院在中国内地仲裁是否属于临时仲裁,是否应当承认和执行在中国内地做出的国际商会仲裁裁决三个问题。本文主张展望中国承认与执行外国仲裁裁决的发展,中国仲裁立法应在承认临时仲裁和建立非内国裁决标准这两方面有新的突破。
The Ningbo Intermediate People’s Court of Zhejiang Province made the first civil ruling to recognize and enforce foreign arbitral awards made in mainland China and received widespread industry concerns. This article focuses on three issues: whether ICC Arbitration can be arbitrated in mainland China; whether Arbitration at ICC Arbitration in Mainland belongs to interim arbitration; whether ICC arbitration awards in Mainland China should be recognized and enforced. This article advocates looking forward to China’s recognition and enforcement of the development of foreign arbitration awards. China’s arbitration legislation should make new breakthroughs in recognition of interim arbitration and the establishment of non-domestic arbitration standards.
