中美两国最近在专利申请量、专利诉讼、以及专利法修改的趋势上都发生了重大的变化。中国开始采取更加激进的政策鼓励专利申请,更加强调本国特色,并以立法和司法的形式保护本土创新;美国经过30多年的激进专利政策鼓励高新科技领域的创新后,并在坚守自己独特的专利制度两个多世纪后,开始注重专利权与公众利益的平衡,以及与世界专利体制接轨。中美专利制度的这些走势,隐含着这两个国家对本国创新战略的调整。尽管目前还很难断定这些变化对两国各自的创新究竟是促进还是阻碍,但可以肯定的是,专利申请数量的上升并不意味着一个国家创新能力的提高;过于注重保护本土创新,或者过于注重与国际规则接轨,从长远来讲都不一定有利于创新。
Recently, major changes have taken place in the trend of patent applications, patent litigation and the revision of the patent law between China and the United States. China has started to adopt a more radical policy to encourage patent applications, emphasizing more on its own characteristics and protecting indigenous innovation in the form of legislation and judicature. These trends in the Sino-American patent system imply that these two countries have readjusted their domestic innovation strategies. Although it is still hard to tell whether these changes are a promotion or a hindrance to the respective innovation of the two countries, what is certain is that an increase in the number of patent applications does not mean an increase in the innovation capability of a country; it places too much emphasis on the protection of indigenous innovation or over Focus on international standards, in the long run are not necessarily conducive to innovation.
