在全球治理体系亟须变革的时代背景下,中国提出积极推动国际法治建设,使全球治理向更加公正合理的方向发展。推动国际法治构建成为中国参与全球治理的重要战略。国际法治构建应当遵循国际法面前的平等、国际法的完整性、依法而治防止专断、法律的有效实施等基本要求。基于这些要求,中国应当在国内立法中树立国际思维,注重国内法与国际法的协调统一;与发展中国家一起积极参与联合国等政府间国际组织的法律编纂和议定活动;支持并引导中国企业法人、社团法人参与非政府间国际组织“示范法”的制定;推动国际执法机制的建立与完善,促进国际法的有效实施;维护国际司法的公正与权威,善于利用国际司法或准司法机制解决国际争端。
Against the backdrop of the urgent need for change in the global governance system, China has proposed to actively promote the building of an international legal system so that global governance will develop in a more just and reasonable direction. Promoting the establishment of international rule of law has become an important strategy for China to participate in global governance. The construction of an international rule of law should follow the basic requirements of equality before international law, the integrity of international law, the dictation of laws and the prevention of arbitrary arbitration and the effective enforcement of laws. Based on these requirements, China should establish international thinking in domestic legislation, emphasize the coordination and harmonization of domestic laws and international law, actively participate in the legal compilation and negotiation of international intergovernmental organizations such as the United Nations with developing countries, support and guide Chinese corporate juridical persons, The incorporation of legal persons into the development of non-governmental international organizations and the “Model Law”; promoting the establishment and improvement of international law enforcement mechanisms to promote the effective implementation of international law; safeguarding the fairness and authority of international justice; making good use of international judicial or quasi-judicial mechanisms to resolve international dispute.
