国际法权威论著在阐述契约性条约问题时,几乎一致认为契约性条约不是国际法的渊源,甚至还认为造法性条约也不是国际法的渊源;但同时又都认为国际法渊源的内容包括国际条约。既然条约不是国际法渊源,那么国际法渊源的内容又怎么可能包括国际条约呢?这一理论观点形成了我国国际法学上的一大理论误区。否定契约性条约是国际法渊源的理论观点不仅是自相矛盾的,而且是错误的。契约性条约是国际条约的重要组成部分,也是国际法的渊源之一。最早的契约性条约与造法性条约分类的理论并没有将契约性条约排除在国际法渊源之外,契约性条约也是创设国际法规则的协议,它在一定条件下可以演变为约束多数国家的造法性条约。国际法权成学者关于国际法渊源的概念也没有排除契约性条约。恰恰相反,他们都一致认为,国际条约和国际习惯是国际法的主要渊源,而契约性条约正是国际条约的一部分。可见,契约性条约完全符合国际法渊源的概念及其包括的内容,它无论从理论上还是实践中都应当是国际法渊源的重要组成部分。

Contractual treaty is an important part of international treaties, but also one of the sources of international law. The earliest theory of contractual and procedural treaty classification did not exclude the contractual treaty from the sources of international law. Contractual treaty was also an agreement to create the rules of international law. Under certain conditions, it could evolve to constrain the law of most countries Sexual treaties. The concept of the origin of international law by scholars of international law also does not exclude a contractual treaty. On the contrary, they all agree that international treaties and international customs are the main sources of international law, and that contractual treaties are just one part of international treaties. It can be seen that a contractual treaty fully conforms to the concept of the origin of international law and its contents and should be an important part of the source of international law both in theory and in practice.
