“小灵通”是在电信竞争和管制规则没有有效发挥作用的情况下发展的 ,其运营过程伴随着不公平竞争 ,这种电信领域不公平的无序竞争 ,反映了目前我国电信管制立法、执法中存在的问题。从法律角度看 ,这些问题应当通过确立促进竞争的管制指导思想、完善相关管制性立法 ,建立健全电信竞争法规范以及改革电信企业产权制度来解决。
