行政公正是指行政权力正当地分配权利(义务)的行为、观念和制度。行政公正要求行政权力的行使本身是公正的;要求行政权力对权利(义务)进行分配;同时要解决怎样分配的问题。社会公正的根本问题是亚里士多德所讲的“分配公正”,行政公正亦即行政权力给每个个体分配权利与义务的公正。因此,行政公正的实质是控制权力,分配权利(义务)。
Administrative justice refers to the behavior, concept and system that administrative power allocates rights (obligations) properly. Administrative justice requires that the exercise of executive power is itself fair; the executive power is required to allocate rights (obligations); and at the same time, the issue of how to allocate rights should be solved. The fundamental problem of social justice is Aristotle’s “distribution of justice,” and administrative justice, that is, the impartiality of administrative power in assigning rights and obligations to each individual. Therefore, the essence of administrative justice is controlling power and assigning rights (obligations).
