卡尔沃主义曾经是发展中国家,特别是拉美国家主张经济主权,反对国际干预的最鲜亮的国际法理论旗帜。然而,这一面旗帜却未能抵挡近二十年来国际投资自由化的汹涌大潮。以至于到20世纪90年代中期,有人宣告“卡尔沃主义即将死亡”!近数年来,随着国际投资争端的急剧上升,许多发展中国家,特别是一些拉美国家不堪重负。在这些国家重新反思、检讨和调整国际投资自由化政策的过程中,卡尔沃主义似乎正在“再生”。本文旨在研究作为卡尔沃主义首倡者的拉美国家对这一重要国际法理论的“否定之否定”的态度嬗变过程,并在此基础上,探讨其对广大发展中国家,特别是中国的借鉴意义。
Karovarism was once the brightest banner of international law advocated by developing countries, especially Latin American countries, for economic sovereignty and opposition to international interference. However, this banner failed to withstand the surging tide of international investment liberalization in the past two decades. That by the mid-1990s, some people proclaimed that “the death of Calvo Doctrine” will come! In recent years, with the drastic rise in international investment disputes, many developing countries, especially some in Latin America, have been overwhelmed. In the process of these countries rethinking, reviewing and adjusting policies on international investment liberalization, it seems that Calvo Doctrine is “regenerating.” The purpose of this paper is to study the evolution of the “negative negation” attitude of Latin American countries, the first advocate of Calvo doctrine, to this important theory of international law. On the basis of this, this study explores the progress of its attitude toward the vast number of developing countries, especially China Reference meaning.
