敦煌契约文书,是卷帙浩博的敦煌遗书中的重要组成部分之一,包括借贷、买卖、雇佣、租佃、分书、放书、遗书等类别,总数约300件左右。这批文书对研究我国古代的契约制度以及由此所反映出的社会经济活动、法律生活等方面,具有弥足珍贵的重要价值。新中国成立以来,中外学术界在敦煌契约文书的刊布与研究方面取得了辉煌成就。笔者整理了1949年以来的中外学者此方面的相关研究文献,作一综合性的评述,以就教于学界。 The Dunhuang contract document is one of the most important parts of Dunhuang posthumous writings, including borrowing, buying and selling, hiring, tenancy, book division, release of books, suicide note, etc. The total number is about 300 pieces. These instruments have a tremendous and important value for studying the ancient contract system in our country, as well as the social and economic activities and legal life reflected thereby. Since the founding of New China, Chinese and foreign academic circles have made brilliant achievements in the publication and research of the contractual instruments in Dunhuang. The author has sorted out the related research literature of Chinese and foreign scholars since 1949, and made a comprehensive review in order to teach in academia.
