秘密拍照、摄像属于秘密侦查行为的一种。在功能上,其能够高效地实现固定证据、查明案件事实,查获犯罪嫌疑人的目的。但是,秘密拍照、摄像也是对公民的基本权利侵犯危险较大的行为。在秘密拍照、摄像问题上,体现着控制犯罪与隐私权的冲突、程序公正与实体公正的矛盾。因此,应当对秘密拍照、摄像进行正确定位和规制,避免其恣意而侵犯公民的基本权利,使其成为保卫国家、社会和公民的强大力量。
Secret photo, camera is a kind of secret investigation. In function, it can effectively achieve the fixed evidence, identify the facts of the case, seized the suspects. However, the secret camera, video camera is also a violation of the basic rights of citizens dangerous behavior.
