作为公法的一项重要原则,比例原则与公民基本权利的保障密切相关。任何对基本权利构成妨碍的干预措施,必须符合比例原则的要求。网络谣言入罪主要涉及言论自由权、隐私权等公民基本权利,需进一步判断该项基本权利的干预措施是否逾越了比例原则的限制。本文通过对比例原则进行分析,分别审查网络谣言入罪与三个子原则(即妥当性原则、必要性原则、狭义的比例性原则)的关系,得出网络谣言入罪不符合比例原则的结论。
As an important principle of public law, the principle of proportionality is closely related to the protection of citizens’ basic rights. Any intervention that impedes basic rights must comply with the principle of proportionality. Invasion of network rumors mainly involves the basic rights of citizens such as freedom of speech and privacy, and the need to further determine whether the intervention of the basic rights is beyond the principle of proportionality. This article analyzes the principle of proportionality, examines the relationship between the rumor of network rumor and the three sub-principles (ie the principle of properness, necessity and narrowness) and concludes that the rumor of online rumor does not accord with the principle of proportionality.
