2007年,《中华人民共和国物权法》(以下简称《物权法》)颁布,这部重在保护公民合法私有财产的法律给那些饱受拆迁行为侵权的人们带来了希望,但是在现实生活中,暴力商业拆迁事件仍在不断侵犯着公民的权益。究其原因,在于现行的行政型商业拆迁模式使拆迁方和被拆迁方处于一种不平等的地位。所以,在《物权法》颁布的背景下研究一种新型民事性商业拆迁模式,即一种以《物权法》为理论基础,以保护公民合法私有财产为主旨,贯彻民法中契约自由的精神,使商业拆迁中的拆迁方与被拆迁方处于平等地位的新型房屋拆迁模式,是解决社会上的暴力商业拆迁侵权难题的关键所在。
