由于证明标准在诉讼证明活动中居于重要地位,因此,在我国诉讼法学界,有关证明标准问题的讨论未有间断。该文试图从微观经济学的视角出发,运用边际成本—收益模型对民事证明标准最优化问题进行研究,提出应针对不同民事证明对象设置不同盖然性程度的证明标准体系。 As the standard of proof occupies an important position in the litigation proving activities, there is still no discussion on the standard of proof in the field of litigation law in our country. This paper tries to use the marginal cost-benefit model to study the optimization of civil proof standards from the perspective of microeconomics, and proposes a standard system of proofs that should be set for different civil probabilities.
