短信息在为我们带来极大便利的同时,也给我们的生活带来了一些负面影响。垃圾短信通常包含虚假和欺诈的广告宣传、传销、骚扰、色情和封建迷信等内容,这些垃圾短信无处不在,几乎所有的手机用户都曾经并继续遭受其骚扰,甚至出现了诸多危害国家安全和社会治安以及侵害他人合法权益的不良现象。垃圾短信对人们的财产权、健康权和隐私权的侵害是一个不容忽视的问题。针对垃圾短信所带来的新的侵权问题,各界纷纷呼吁有关部门加强对垃圾短信的治理,包括建议对恶意利用短信进行欺诈或者肆意传播淫秽短信等行为采取适当的法律制裁,执法机关、电信运营商等为此已采取了各种措施加以打击。越来越多的人认识到,只有依法打击才能治本,但当前治理垃圾短信的一个不利因素就是现行法律制度不够完善,甚至还出现了法律上的空白。同时,其他行之有效的措施也需要尽快地付诸实践,以达到清除垃圾短信,净化手机短信服务的目的,使短信的功能价值能够真正实现。
