在国际海运公约的立法过程中,单位赔偿责任限制是承运人赔偿责任制度中的一项重要内容,也是UNCITRAL起草运输法公约过程中的重点和难点之一。本文分析了单位赔偿责任限额的有关争议,明确了确定责任限额时应当考虑的因素,并对各项考虑因素进行了优劣次序的排列。在此基础上,笔者对迟延交付责任限额以及货物灭失、损坏责任限额的确定提供了各自的思路,并为我国将来修改《海商法》提出了立法建议。
In the process of the legislation of UNCITRAL, unit liability limitation is an important part of carrier liability system and one of the key and difficult points in the UNCITRAL drafting of the transport law convention. This article analyzes the relevant dispute about the liability limit of the unit, clarifies the factors that should be considered in determining the liability limit, and arranges the order of the factors for consideration. On this basis, the author provides their own ideas on the limit of liability for delay delivery and the determination of the liability limit for loss of goods and damage, and puts forward legislative proposals for the revision of Maritime Law in the future.
