民族民间文学艺术作品与著作权有着密切的联系,著作权应在保护民族民间文学作品中起到主导作用。但民族民间文学艺术作品在权利主体、时间及形式上的不确定性与著作权法所要求的作品的确定性有着冲突。立法、行政、加强民族民间对此的思想意识等途径可以消除这种冲突,加强对民族民间文学艺术作品的著作权保护。
National folk literature and art works are closely linked with copyright, and copyright should play a leading role in the protection of national folk literature. However, there is a conflict between the uncertainty of rights, the time and the form of national folklore works and the certainty of the works required by copyright law. Legislation, administration and strengthening of ideological and ideological awareness of ethnic folk can eliminate such conflicts and strengthen the protection of the copyright of national folk literature and art works.
