随着复制技术的发展,尤其迈进网络时代之后,私人复制俨然对版权人的利益构成了严峻挑战。原先的法律制度不能解决新技术带来的问题,因此时代呼唤新制度的诞生。版权补偿金制度就担当起了重新构建版权利益平衡的时代重任。国外的版权补偿金制度虽然创建的比较早,并且发展的相对成熟,但是该制度在我国法律尚属空白。因此在网络时代私人复制的版权保护的严峻挑战下,我国著作权法亟需引入该制度。本文运用历史考察法和比较分析法,通过分析国外补偿金制度的发展历史和构成要素,以期为我国引入版权补偿金制度提出了一些建设性意见。
With the development of replication technology, especially after entering the Internet age, private copying seems to pose a serious challenge to the copyright owner’s interests. The original legal system can not solve the problems caused by new technologies, so the era calls for the birth of the new system. The system of copyright compensation took the important task of reconstructing the balance of copyright interests. Although foreign copyright compensation system was created earlier and developed relatively mature, the system in our country is still blank. Therefore, under the serious challenge of the copyright protection of private copying in the internet age, the copyright law of our country urgently needs to introduce this system. Based on the historical investigation and comparative analysis, this paper analyzes the history and elements of the development of foreign compensation system, and proposes some constructive suggestions for the introduction of copyright compensation system in our country.
