建构主义教学论将学生作为教学中的认知主体,强调“情境”的重要作用和“协作学习”的关键作用,主张创设良好的学习环境、构建以质性评价方法为主的评价机制。我国证据法学“填鸭式”的传统教学模式不符合建构主义教学观的要求,现有的案例教学、模拟法庭、诊所式法律教育、教学实习等改革措施也或多或少存在不符合证据法教学实践要求等问题。应以建构主义教学观为指导,尊重学生的主体地位,创设证据“情境”和良好的学习环境,增强教学活动的交互性,全面发挥“协作学习”的关键作用,改革证据法学教学评价模式。
