本文通过比较美国土地发展权转让制度和中国土地用途管制制度及耕地指标交易等地方创新实践,指出在中国土地用途管制制度创新中,应借鉴美国土地发展权转让的经验,引入市场机制,重点关注土地发展权的界定、配置及价值确定、发展权市场的建立及发展权转让过程中的监督问题,对各方面的效应进行充分的分析及权衡取舍,努力形成更为合理、完善的新制度。
By comparing the land use rights transfer system in the United States with the innovative practices in China’s land use control system and the cultivated land index trading, this article points out that in the innovation of China’s land use control system, we should learn from the experience of the transfer of land development rights in the United States, introduce the market mechanism and focus on The definition, allocation and value determination of the land development rights, the establishment of the development rights market and the supervision in the process of the transfer of the development rights make full analysis and trade-off between the various aspects of the effects and strive to form a more reasonable and perfect new system.
