我国的碳排放交易机制正处在积极的探索阶段。在我国承担强制性的碳减排国际义务之前,自愿性排放权交易都将作为重要的一种碳交易机制活跃于我国的碳排放交易市场。基于环境自愿协议和自愿性排放权交易在特征、目标等方面的诸多共同点以及环境自愿协议在我国的成功实践,探索自愿协议型排放权交易制度具有一定的可能性和必要性。本文尝试描述了自愿协议型排放权交易制度的参与主体及法律性质、制度规则以及制度环境等内容,搭建出自愿协议型排放权交易制度的粗略框架。
China’s carbon emissions trading mechanism is in an active stage of exploration. Before China undertook the mandatory international obligation on carbon emission reduction, voluntary emission trading will be an important carbon trading mechanism that is active in China’s carbon emissions trading market. Based on the characteristics, goals and other aspects of voluntary agreements and voluntary emissions trading, as well as the successful practice of environmental voluntary agreements in our country, it is possible and necessary to explore the voluntary agreement type emission trading system. This paper attempts to describe the participant body of the voluntary agreement-type emission trading system and its legal nature, institutional rules and institutional environment, to build a rough framework for the voluntary agreement-type emission trading system.
