环境公平视角下的公益林补偿应立足于林业分类经营的政策背景,兼顾公众的的环境利益和林权主体的经济利益。首先应根据财政能力和公益林分布状况的不同,公平界定不同级别和不同区域地方政府间的补偿主体责任;其次应立足于“弥补经济损失”的补偿目标,通过差异化的补偿标准和补偿方式保障公益林经营者的公平受偿。
The compensation of public welfare forests under the perspective of environmental equity should be based on the policy background of the classified management of forestry, taking into account the public’s environmental interests and the economic interests of the forest rights owners. First of all, according to the different financial capacity and the distribution of public welfare forests, we should define the main responsibility of compensation between different levels and different local governments according to the distribution of financial capacity and public welfare forest. Secondly, we should base on the compensation target of “make up for economic loss”, through differential compensation standard and Compensation methods to protect the public welfare forest operators fair compensation.
