服务贸易总协定(GATS)是国际上有关服务贸易的第一个多边法律框架。不过,在WTO于1995年1月1日开始运行时,GATS中并不包含关于服务贸易的具体补贴纪律。尽管GATS第15条要求WTO的成员进行服务贸易补贴规则的谈判,但是,迄今为止,相关规则尚未达成。那么,服务贸易补贴规则谈判的困难在哪里?如果多边谈判进展缓慢,是否可以通过区域贸易安排或其他机制来对服务贸易补贴进行规制?我国应如何应对?本文拟对此进行探讨。
The General Agreement on Trade in Services (GATS) is the first multilateral legal framework in the international trade in services. However, when the WTO came into operation on January 1, 1995, the GATS did not include specific subsidy disciplines on trade in services. Although Article 15 of the GATS requires members of the WTO to negotiate rules on subsidies for trade in services, the relevant rules have not yet been reached so far. So, what are the difficulties in negotiating the rules of service trade subsidy? If the progress of multilateral negotiations is slow, can we regulate the subsidies of trade in services through regional trade arrangements or other mechanisms? How should our country deal with this?
