国际公约和各国法律均为国际商事仲裁裁决的司法审查专门设置了公共秩序条款,规定对于违背公共秩序的国际商事仲裁裁决可予以撤销或拒绝承认与执行。同时公共秩序条款与其他司法审查的条件不同,法院援用公共秩序条款一般可依职权裁定,而其他司法审查的条件法院往往只能在当事人提出抗辩时得以援用。如根据《纽约公约》第5条第2款的规定,被请求承认和执行外国仲裁裁决的国家的管辖当局如果查明承认和执行该仲裁裁决将和这个国家的公共秩序相抵触时,可以拒绝承认和执行该外国仲裁裁决。因此,公共秩序是法院在对国际商事仲裁裁决实
International conventions and national laws all set up special public order clauses for the judicial review of international commercial arbitration awards. They provide that international commercial arbitration awards that violate public order may be withdrawn or refuse recognition and enforcement. At the same time, the terms of public order are different from those of other judicial review. The terms of public order imposed by the courts are generally adjudicated according to the terms of reference. The conditional courts of other judicial review can often be invoked only when the parties have filed a defense.
