基于国家主权平等的传统国际法原则反映了国际社会的结构及现实,但这并不能作为巩固国际法规则及国际法法治理念的唯一标准。不同于在过去的国际社会中获得广泛认同的同类的国际法原则,作为一项发展中的国际法基本原则,可持续发展原则在当代国际法中并不是一种具体的法律义务,但它确实表明了一个目标,这个目标能够影响案件结果、条约的解释、国家和国际组织的实践,而且它也可能导致现存法律的重大变革和发展。从这个意义上来讲,国际法确实应要求国家和国际组织考虑可持续发展的目标并为实现此目的而确立适当的程序。
The traditional principles of international law based on the sovereign equality of nations reflect the structure and reality of the international community. However, this can not serve as the sole criterion for consolidating the rules of international law and the rule of law in international law. Unlike the principle of similar international law widely recognized in the past in the international community, the principle of sustainable development, as a founding principle of international law under development, is not a specific legal obligation in contemporary international law but it does indicate a Goal that can affect the outcome of the case, the treaty’s interpretation, the practice of States and international organizations, and it can also lead to major changes and developments in existing laws. In that sense, international law should indeed require that States and international organizations consider the goal of sustainable development and establish the appropriate procedures for that end.
