德国行政法教义学上“不确定法律概念可完全司法审查”是一个应予放弃的观念。从法理学的角度审视,这个观点的诸多前提条件是无法满足的。不确定法律概念的应用意味着规制密度的降低和向行政机关赋予酌定空间。承认不确定法律概念赋予行政机关酌定空间并不意味着行政司法审查强度的降低,原则的具体化思想既能为此提供可操作的方法和标准,也能更为完美地建构相应的教义学体系。在此特别值得深入思考的是,原则的具体化思想意味着何种属性的审查以及何种审查密度。针对这一问题,本文对于最低限度的审查尺度进行了细致的思考。
The doctrine of administrative law in Germany is that “the concept of law of indefinite law can be completely judicial examined” is an idea that should be abandoned. Viewed from jurisprudence, many of the preconditions for this view are unmet. The application of the notion of legal uncertainty implies a reduction in the regulatory density and a discretionary space for the executive. Admitting the notion of indefinite law gives discretionary space to the executive does not mean the reduction of the intensity of the administrative judicial review. The specific thought of principle can not only provide operable methods and standards for this purpose, but also construct the corresponding doctrine more perfectly system. What deserves deep consideration here is the examination of what kind of attributes and what density of censorship is the concrete thought of principle. In response to this issue, this article for a minimum review of the scale of a careful consideration.
