自认制度,乃民事诉讼中的一项重要制度。在大陆法系中,行政诉讼与民事诉讼有诸多相近之处,且在行政诉讼之立法中也出现类似自认之规定。本文以诉讼法理为基础,对自认之根据及自认适用于行政诉讼之范围进行讨论,并对我国现行立法提出完善之建议。 Recognition system, civil procedure is an important system. In civil law system, there are many similarities between administrative lawsuit and civil lawsuit, and there are similar self-admitting rules in the legislation of administrative lawsuit. Based on the law of litigation, this article discusses the basis of self-identification and the range of self-infringement applicable to administrative litigation, and puts forward suggestions for perfecting the current legislation in our country.
