就世界各国(地区)的制度设置而言,基于对刑事诉讼规律的尊重,普遍重视庭前准备程序的制定与运作。在美国联邦刑事诉讼规则中就有这样的规定,法庭可以命令举行一次或多次会议来研究考虑诸如促进公正、迅速审判等类事项。通过庭前准备程序,可以理清案件的争议点,有效地进行法庭审理,对诉讼效率的提升发挥着积极作用。我国2012年刑事诉讼法的修改,对庭前准备程序也作了相应的调整,在刑事诉讼法第40条、第172条、第182条等改革措施中,庭前会议制度最为引人注目。
As far as institutional arrangements in various countries (regions) in the world are concerned, based on respect for the law of criminal procedure, there is a general emphasis on the formulation and operation of the preparation process for the courtroom. In the United States Federal Rules of Criminal Procedure, there is such a rule that courts may order one or more meetings to consider such matters as promoting fairness and speedy trial. Through the pretrial preparation procedure, disputes in the case can be cleared up, and the court hearing can be conducted effectively, which plays an active role in improving the efficiency of litigation. The revision of China’s Criminal Procedure Law in 2012 also made corresponding adjustments to the preparation process before the court. Among the reform measures in Articles 40, 172 and 182 of the Criminal Procedure Law, the pre-trial meeting system was the most noticeable.
