各国学者为在民事诉讼中当事人是否有义务陈述事实已经争论过多次。从道德的层面而言民事诉讼当事人应有义务遵循诚实守信的原则,讲述事实,国外大多发达国家都明确要求公民履行这一义务。在现在使用的《民事诉讼法》中有相关规定。在民事诉讼程序中,当事人真实陈述案情,有利于诉讼案顺利进行,让法官先做出最公正、公平的判决,利于社会安定和谐。在民事诉讼案中,当对方当事人对当事人陈述事实的真实性提出质疑时,由法官对当事人收集的证据进行识别并作出判断。假如当事人在诉讼案中做出虚假陈述,对方当事人可以在规定时间内提出赔偿诉讼,最后由法院做出公正判决。本文就诉讼案中当事人真实陈述义务进行全面分析。
Scholars in various countries have argued whether parties are obligated to state facts in civil litigation. From the ethical level, litigants should have the obligation to follow the principle of honesty and trustworthiness and tell the truth. Most developed countries in foreign countries have explicitly requested citizens to fulfill this obligation. There are relevant provisions in the Code of Civil Procedure now in use. In the civil procedure, the factual statement by the parties of the case is conducive to the smooth progress of the litigation, allowing judges to make the most fair and fair judgments, which will be conducive to social stability and harmony. In civil litigation, when the other party questions the authenticity of the parties’ facts, the judge identifies the evidence collected by the parties and makes a judgment. If a party makes a false statement in a lawsuit, the other party may file a compensation lawsuit within the prescribed time and finally make a fair judgment by the court. This article carries out a comprehensive analysis of the litigant’s true presentation obligations.
