因为对天气预报的法律性质的认定存在较大的争议,所以近年来产生了许多关于天气预报的诉讼纠纷。有的认为天气预报属于作品的范畴;有的则认为其不具有独创性,属于公共信息。笔者在借鉴关于电视节目预告表的争论结果的基础上,认为:天气预报属于权利人的一种财产,不应受到著作权法的保护。 Because there is much controversy over the legal nature of the weather forecast, many litigation disputes over the weather have taken place in recent years. Some people think that the weather forecast belongs to the category of works; while others think it is not original, which is public information. Based on the controversy about the TV schedule, the author thinks that the weather forecast belongs to a kind of property of the obligee and should not be protected by the copyright law.
