中国要真正成为世界格局中一个负责任的贡献者,一个关键的因素是当代中国立法制度在全球结构深化过程中的规范建构能力与制度本身的变革水平。对此,当代中国立法制度必须有一个基本的认识和判断,充分利用全球化时代国际规则体系所带来的积极影响以提升立法制度的竞争力,同时努力避免国际规则体系对当代中国立法制度维护国家主权能力的消极影响。在面对这一嬗变诉求的过程中,当代中国立法制度应寻求与中国社会发展阶段、改革开放与法律体系自身规律相适应的锐变依据。
