去年媒体报道了多起档案拍卖案,按照《中华人民共和国档案法》第十六条第二款的规定,属于个人所有的对国家和社会有保存价值的档案(法定档案的第二部类)在向国有档案馆以外的组织或个人出卖时,需要向档案行政管理部门提出申请,获取许可。但这些拍卖活动并未履行这种法律义务。原因何在?笔者以为,主要问题出在法律规定的内容本身。如是规定,是国家全能主义和法律父爱主义的表现。鉴于此,需要对这一条款予以修改。
Last year, the media reported a number of file auction cases. According to Article 16, paragraph 2, of the “Archives Law of the People’s Republic of China,” all belong to the individual’s archives that have preserved value for the country and society (the second category of legal archives) When selling to organizations or individuals outside the state-owned archives, they need to file an application with the archives administrative department for permission. However, these auctions do not fulfill such legal obligations. The reason why? I believe that the main problem lies in the content of the law itself. If this is the case, it is a manifestation of national totalitarianism and law-factionalism. In view of this, this clause needs to be amended.
