宪法赋予检察机关法律监督职能之所以难于落到实处,其根本原因在于《刑事诉讼法》违背检察权配置的规律和原理,将检察机关的法律监督模式定位为一种以“消极中立”为理论支撑的“外在式”监督。这种监督模式直接导致实践中侦查监督难、审判监督难、执行监督难等困境。为确保检察监督的实效性,强化检察机关的法律监督职能,借鉴大陆法系国家刑事诉讼法中的有关规定,转变法律监督的模式,即由“外在式”监督转变为“参与式”监督,将检察机关定位为侦查权以及刑罚执行指挥权的法定主体,并通过积极介入侦查、审判、执行等程序,具体行使侦查权、公诉权和执行权的方式来履行其法律监督职能,乃当务之急。
