信托制度来源于普通法系,但由于其本身具有的巨大优势,以至于部分大陆法系国家对该制度进行了法律移植,本文意在通过考察各国对待信托制度以及处理这一障碍的不同立法例来进行我国信托法的立法反思。
The trust system originates from the common law system. However, due to its own great advantages, some countries in the civil law system transplanted the system. This article attempts to examine the system of trust in different countries and different legislative cases that deal with this obstacle To carry on the legislative reflection of China’s trust law.
