我国环境警察权有其产生和存在的基础。政策支持、现实需要、国内实践及域外经验构成了我国环境警察权产生和存在的现实基础;警察权理论和环境权理论构成了我国环境警察权产生和存在的直接理论基础;我国现有法律中有关公安机关部分的环境管理及环境执法权是我国环境警察权存在的法律基础。而我国环境警察权体系的最终形成还需要理论研究的支撑及相关立法进行合理配置和系统明确的规定。
China’s environmental police power has its foundation and existence. Policy support, realistic needs, domestic practice and extraterritorial experience form the realistic basis for the emergence and existence of environmental police power in our country. The theory of police power and environmental rights constitute the direct theoretical basis for the emergence and existence of environmental police power in our country. The environmental management and environmental law enforcement of the public security organs are the legal basis for the existence of environmental police power in our country. The final formation of China’s environmental police power system also needs the support of theoretical research and related legislation to make reasonable allocation and system-specific provisions.
