本文针对我国现行立法和实践,探讨了陪审制度的基本概念、分类和我国陪审制度发展过程。陪审制度对人民法院的法律监督是十分必要的,但这种监督必须以保障法院独立地行使审判权为前提。我国应当强化实行陪审制度,改革和完善陪审制度体系。 Based on the current legislation and practice in our country, this article explores the basic concepts, classification and development of jury system in China. Jury system on the people’s court legal supervision is very necessary, but such supervision must be to protect the court to exercise the power of the judiciary as an independent premise.
