医疗纠纷目前已成为社会热点问题之一,它的合理解决有赖于相关法律的完善。理论界将医患关系分为行政关系、服务合同关系和消费关系等,目前争论的焦点就集中在患者是否属于消费者。本人认为,医患关系就其实质而言应属于民事法律关系中的合同关系,患者不是消费者,医疗机构也不是经营单位,医疗纠纷不应适用消费者权益保护法。
Medical disputes have now become one of the hot issues in society, and its reasonable solution depends on the improvement of relevant laws. Theorists divide medical doctor-patient relationship into administrative relationship, service contract relationship and consumer relationship. At present, the debate focuses on whether patients belong to consumers or not. In my opinion, the doctor-patient relationship should, in essence, belong to the contractual relationship in the civil legal relationship. The patient is not a consumer, the medical institution is not a business unit, and medical disputes should not apply the Consumer Protection Law.
