“偷拍偷录”是新闻采访尤其是新闻媒体开展舆论监督工作的有效、合法手段。在新闻官司中，新闻媒体“偷拍偷录”的音像资料具备诉讼证据的基本特征，可以作为视听资料证据使用。对于最高人民法院相关司法解释应当作限定性理解。
“Stealing and filching” is an effective and legal means for press interviews, especially news media, to carry out public opinion supervision. In the news lawsuit, the audio-visual materials of “secretly filing” recorded by the news media possess the basic features of litigation evidence and can be used as audio-visual material evidence. For the Supreme People’s Court related judicial interpretation should be limited understanding.
