土地征收是指国家为了社会公共利益的需要,按照法律规定的批准权限和批准程序,并给农民集体和个人补偿后,将农民集体所有土地转变为国家所有。因此,土地征收是发生在国家和农民集体之间的土地所有权转移。由于我国现行法律对该类所有权转移的规范不尽完善,本文将对其中存在的主要问题进行比较分析和研究,并提出解决问题的思路。 Land expropriation refers to the state’s need for social public interests, according to the law to approve the authority and approval procedures, and to the collective farmers and individuals compensation, the collective land of peasants into state ownership.
