据中国农业新闻网2013年9月10日报道,全国人大常委会于近日通过了关于修改商标法的决定,修改后的新商标法将于2014年5月1日起施行。厘清驰名商标保护制度是此次修改的内容之一,法律首次禁止“驰名商标”字样用于广告宣传。新商标法第十四条规定了驰名商标认定的考虑因素、三个有权认定机构、三种认定程序,并在第十四条第五款明确规定:生产、经营者不得将“驰名商标”字样用于商品、商品包装或者容器上,或者用于广告宣传、展览以及其他商业活动中。新增加了违反法律将“驰名商标”字样用于广告宣传的法律责任,违反规定的,将处十万元罚款。
