经费是环保执法活动和环保执法能力建设的财力保障。在财政分权体制下,我国地方环保经费来源主要是同级财政预算,对地方财政依赖性强。受制于地方财政状况,多数基层环保部门经费得不到切实保障,从而导致环保执法陷入执法能力不足、权力寻租、执法积极性不高和执法独立性丧失等困境。因此,应通过合理的制度设计来缓解经费困难问题,提高环保执法绩效。
Funding is the financial protection for environmental protection law enforcement activities and capacity-building for environmental law enforcement. Under the system of fiscal decentralization, the sources of local environmental protection funding in our country are mainly the same level budgets and are highly dependent on local finance. Subject to local financial conditions, most grassroots environmental protection departments are not able to secure adequate funding, resulting in environmental law enforcement into law enforcement capacity, power rent-seeking, law enforcement is not high enthusiasm and law enforcement independence loss and other plight. Therefore, we should ease the financial difficulties through rational system design and improve the performance of environmental law enforcement.
