在国际商事仲裁中是否应设立第三人制度一直颇受争议。本文试对国际商事仲裁第三人制度的范畴予以界定,并逐一分析正反两派的观点,认为在国际商事仲裁中设立第三人制度是仲裁价值的追求与意思自治自身发展轨迹的体现,有利于仲裁裁决的终局性,不影响仲裁的经济性、便捷性和私密性,同时也体现了当今国际商事活动的实际需要,是立法和仲裁实务发展的必然趋势。
Whether or not to establish a third party system in international commercial arbitration has been a subject of much controversy. This paper attempts to define the scope of the third party system of international commercial arbitration and analyze the pros and cons of each one by one. It is believed that the establishment of a third party system in international commercial arbitration is the embodiment of the pursuit of arbitration value and the development path of autonomy of autonomy. It is in favor of the finality of the arbitral award and does not affect the economy, convenience and privacy of the arbitration. It also reflects the actual needs of today’s international commercial activities and is an inevitable trend in the development of legislative and arbitration practice.
