转化犯是指行为人在实施某些犯罪之时或之后,由于特定主客观事实因素的变化,使整个行为符合另一犯罪的构成,法律规定以后一犯罪定罪处罚的犯罪形态。转化犯具有的两大重要特征:转化犯具有法定刑,即必须是法律明文规定的转化犯情形才能适用;另一个特征是转化犯必定是轻罪到重罪的转化。转化型故意杀人罪的立法必要性一定程度上决定了其合理性,只有立法和实务兼有必要性时才可以设立转化型故意杀人罪。转化型故意杀人罪是因为某种主客观事实因素的的出现使前罪的性质发生了质变,前罪的构成要件无法包含某些具有更严重社会危害性的重行为和重结果,因此,转化犯不能被结果加重犯代替,其具有独特的立法价值。
