交通部出台的《关于深化改革进一步推进出租汽车行业健康发展的指导意见(征求意见稿)》产生了网约车的监管问题的讨论。本文应用成本收益理论对网约车的监管进行分析,比较传统巡游式出租车经营、新规之前的出租车经营与新规之后的出租车经营中消费者、出租车驾驶员与出租车经营者的成本收益,并且比较特许经营与一般许可经营对于监管者的成本收益,得出应当采取一般许可的监管模式。
