随着现代国家职能的变化,严格意义上的绝对分权已经不复存在,客观上要求法院承担公共政策创制的功能。由于规则之治存在着的不周延性、不确定性及滞后性等不足,如果完全否认了公共政策的创制功能,法院的其他功能也将无法实现。另外,从法院与立法、行政机关比较的外在角度看,通过法院创制公共政策更容易实现形式正义与实质正义的协调。上述三点结合共同构成了法院创制公共政策的必要且充分的理由。
With the change of modern state functions, the absolute decentralization in the strict sense no longer exists, and objectively requires the court to assume the function of creating public policies. Due to the indefinite, uncertain and lagging nature of rule rule, if the function of public policy creation is completely denied, the other functions of the court will not be realized. In addition, judging from the external comparison between the court and the legislative and administrative organs, the coordination of formal justice and substantive justice can be achieved more easily through the creation of public policies by courts. Together, the above three points constitute the necessary and sufficient grounds for the courts to create public policies.
